GENERAL CONDITIONS

These General Conditions govern the methods and terms with which La Radice di M. Ravasio & C. SNC provides the services of its online or on-site platform
The Customer may use the website owned by La Radice di M. Ravasio & C. SNC, available at the address www.EasyLockersBergamo.it, only if (in the case of a natural person) he has the capacity to act, in particular or (in case of a legal person) is the holder of the relevant powers, in particular he has the right to stipulate binding contractual obligations.
The contract for storage and other services is stipulated with the company La Radice di M. Ravasio & C. SNC owner of the registered trademark “Easy Lockers Bergamo” and of the website www.EasyLockersBergamo.it, which agrees to stow luggage/objects of its customers in its baggage deposits.
By leaving your luggage in our Città Alta Lockers and in the luggage storage, you accept the terms and conditions set out in our storage contract and/or in the contract for the provision of various services, on your own behalf and/or on behalf of any other interested person .

The luggage storage service consists of the rental of temporary spaces in special automatic lockers for the storage of luggage/personal objects in our stores for the period chosen by the customer during the booking/registration phase.
Access to the Platform and, therefore, to the service, occurs by completing an online form or in the store.

• The Customer is informed that he has no right to withdraw from the transaction, which he expressly renounces in light of the specificity of the service, and that the reservation is non-refundable.
• The booking email and/or receipt that “La Radice di M. Ravasio & C. SNC” sends with the booking constitutes the booking.
• The locations are open seven days a week. Working hours may vary slightly depending on the bag drop, so please double-check them on each specific page dedicated to the individual bag drop.
• Reservations can be made on the website 24 hours a day.
• Animals are prohibited in all lockers and/or all rooms.
• Smoking is not permitted inside our baggage storage areas.
• Access (to the service) is limited to people over the age of 18 or accompanied minors.
• The maximum weight allowed per locker is 30 kg.
• The Customer is required to check the size and weight of their luggage before making a booking on the site.
• No complaints or refund requests will be accepted if the baggage exceeds these dimensions and/or weight.
• The Customer is also required to ensure that the locker door is properly closed before leaving the luggage storage area he/she has used.
• Please, close the box correctly after use, under penalty of an additional charge of 20.00 €.
• You have not left any valuables in your luggage, for which the Customer remains responsible and for which “La Radice di M. Ravasio & C. SNC” declines all responsibility.
• By baggage we mean bags, suitcases, parcels, parcels, packages, hand suitcases weighing no more than 30 kg each.
• The baggage will be delivered and collected at the shop booked on the website www.EasyLockersBergamo.it on the dates and times indicated in the booking.
• The Customer will be given a ticket/email identifying the stored baggage(s), to be used for collection of the same.
• Baggage in poor condition or unfit for purpose may also be refused.

The Customer assumes all responsibility regarding the suitability of the baggage and objects, goods, substances contained therein in compliance with legal and contractual provisions with particular reference to the prohibition on depositing dangerous and/or harmful materials. Each baggage must be capable to guarantee and protect the contents from tampering and deterioration.

• Flammable or non-flammable compressed gases, poisonous even if cooled.
• Corrosive products even in gaseous form.
• Particularly fragile objects such as glass, bottles, vases.
• Explosives.
• Infectious and poisonous substances.
• Flammable substances.
• Magnetizing material.
• Drugs and similar substances.
• Plants, flowers, animals – neither alive, nor dead.

• You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer or mobile device.
• The contents of your baggage have been securely and carefully packaged so as to be protected from the normal risks of transportation, including any associated sorting and/or handling processes.
• The contents of the baggage do not cause damage to other baggage transported by us and/or stored in our warehouses.
• The contents of the baggage are not a prohibited item and the customer is a person or organization with whom we cannot lawfully trade under applicable laws or regulations.
• All applicable laws and regulations have been complied with, in addition to the provisions of this contract.
• The economic value of each bag including its contents does not exceed 200 €.
• The customer implicitly agrees to indemnify us and hold us harmless from any liability we may suffer, or from any costs, damages or expenses, including legal fees, which we may incur to you or any third party arising from your breach of any of these warranties, obligations and guarantees, including if we inadvertently agree to a hold that contravenes any of your obligations.

• “La Radice di M. Ravasio & C. SNC” are not responsible for the deterioration, damage, decrease in value or size of the luggage, goods, products, objects contained therein due to causes due to force majeure, fortuitous circumstances, and/or or natural events, riots or tumults and, in any case, for causes not attributable to gross negligence.
• “La Radice di M. Ravasio & C. SNC” is not liable for damage to baggage and objects, goods, substances contained therein if they have not been packaged in an adequate and safe manner or, in any case, housed in the baggage in such a way as to make it reasonably foreseeable. the occurrence of damages, faults, defects, decreases in value.
• “La Radice di M. Ravasio & C. SNC” are not liable in any way and/or reason for any damage, loss, defects caused by prohibited articles knowingly deposited and/or kept in luggage.
• “La Radice di M. Ravasio & C. SNC” is not liable for any reason and/or reason for the breakage of parts of the luggage due to its age and/or the poor condition in which it was found.
• “La Radice di M. Ravasio & C. SNC” is not liable for any reason and/or reason for damage caused or attributable to normal wear and tear.
  For the part not covered therein by the rules of the civil code on the storage contract, no liability is attributable to La Radice di M. Ravasio & C. SNC in the event of baggage(s) delayed and/or not collected after the opening hours / closure of our premises.
• Therefore, La Radice di M. Ravasio & C. SNC will not be in any way responsible in relation to duly and fully proven damages, which may be considered a direct and foreseeable or indirect consequence of the delay and/or failure to collect.
• La Radice di M. Ravasio & C. SNC. will therefore not be liable for any flights, trains, goodwill, loss of revenue, profit, market, reputation, customers, use, opportunity, even if we were aware that such loss or damage might occur, nor for any loss or damage, regardless of the damages indirect, incidental, special or consequential causes, including, without limitation, termination of contract, negligence, willful misconduct or default. We will not be liable if we fail to perform any obligation to you due to circumstances beyond our control such as (the following list is illustrative only and not exhaustive): acts of God including earthquakes, cyclones, storms, floods, fires , disease, fog, snow or frost; force majeure including (but not limited to) war, accidents, acts of terrorism, strikes, embargoes, local disputes or popular uprisings; national or local outages; hidden defects or intrinsic defects in the contents of the checked baggage; criminal acts of third parties such as theft, robbery and arson; acts or omissions attributable to you or to third parties whose work you will be responsible for; act or omission attributable to a public official; shipment contents consisting of any item that is a prohibited item by law or under the provisions of this contract, even if we may have accepted the shipment and/or storage in error. We are not responsible for broken handles and/or wheels. The only liability attributable to us in relation to the services provided is governed by these general conditions of conservation.

“La Radice di M. Ravasio & C. SNC” reserves the right to modify these Conditions of Use at any time. The Terms of Use as amended will be applicable from the moment of their publication. If the Customer continues to access the website www.EasyLockersBergamo.it after such publication, his/her full acceptance of the changes is presumed. The Customer is therefore advised to periodically check the conditions applied.

In the event of late baggage collection during working hours (of the baggage storage), “La Radice di M. Ravasio & C. SNC” will charge a supplement of 5.00 € for each hour of delay. Once payment is complete, the Customer will be able to collect their luggage.

If the collection does not occur before the store closing time, but on the following day (or days), “La Radice di M. Ravasio & C. SNC” will charge an additional cost of 20.00 € daily for each day of delay. Upon completion of payment, the Customer will be able to collect their luggage.

• For security reasons, any items or baggage that is forgotten/found and unclaimed will be destroyed after 5 days of the end of the booking.
• If the forwarding of a forgotten item is requested, the Customer assumes all costs, which must be paid in advance. A contribution of 35 € plus shipping costs will be requested, which depend on the weight, destination and shipping method (ordinary mail, UPS, etc.).

The Customer acknowledges and accepts that “La Radice di M. Ravasio & C. SNC” and/or any Government Authority have the right to open and inspect the baggage at any time for security reasons.

Each piece of luggage stored at our company is covered by insurance up to a maximum value of 200.00 € per item. This insurance coverage will compensate the customer for any damage and / or losses directly attributable to Radice di M. Ravasio & C. SNC” within the limits indicated above, as well as in the event of proven theft by third parties.

Such insurance coverage is not available for gemstones, precious metals, watches, plasma screens, LCDs, satellite navigation systems, mobile phones, PCs, tablets, jewelry, money, glass, porcelain, works of art, antiques, documents or films, tapes, discs, memory cards or any other medium containing data or images. The above insurance options do not cover consequential loss, delayed delivery or loss arising from a breach of your obligations under these terms and conditions and are not available for services which do not involve transport. The above options do not cover broken handles and / or wheels.

For anything not expressly provided for or regulated by this contract, reference is made to the provisions of the Civil Code and Italian legislation. All disputes arising from this contract, including those relating to its existence, validity, extinction, interpretation, execution and resolution, will be submitted to the exclusive court of Bergamo.
